Title Lawful Interception (LI); Study on encrypted Electronic Communications Services (ECS)
 
Scope and Field
of Application
The present document contains a discussion about possible approaches for the LI architecture of number-based or number-independent (interpersonal) communications of electronic communications services (ECS), see Directive (EU) 2018/1972 establishing the European Electronic Communications Code and similar acts.
The approaches are designed to realize forwarding copies of communications contents (CC) from a specific target, in accordance with the provisions of the legislation (i.e., so that it can be understood by law enforcement, as defined by the legislation), while maintaining the confidentiality level of the ECS.
The approaches consider the protection and the strict control of usage of the proposed LI mechanism.
The present document addresses considerations arising from the need for the ECS provider to support strong encryption and data protection measures while ensuring compliance with relevant legislation.
The present document includes discussion points put forward by all participants representing a broad range of ideas and reflects all points of view by including feedback (pros and cons) from all stakeholders.
